Terms and Conditions
Chapter 1: General Provisions
Article 1 (Purpose)
- These Terms and Conditions aim to regulate the rights, obligations, and responsibilities of users and Gwangju Metropolitan City Tourism Corporation (hereinafter referred to as "Gwangju Tourism") in relation to the integrated membership services (hereinafter referred to as "Service") provided on the Gwangju Tourism website, as well as other necessary matters.
Article 2 (Effect and Modification of Terms)
- 1.These Terms and Conditions become effective when posted on the Service screen or otherwise communicated to users, and wheGwangju Tourism may modify these Terms and Conditions if deemed necessary. Modified terms will be announced on the Service screen so that users can review them directly.
- 2. n users agree to these Terms and Conditions by signing up for the Service.
- 3.If users do not agree to the modified Terms and Conditions, they may stop using the Service and cancel their membership. Continued use of the Service will be considered acceptance of the modified Terms, which will be effective in the same manner as described in the preceding paragraph.
- 4. If users agree to these Terms and Conditions, they will apply primarily to the actions of Gwangju Tourism in providing the Service and to users' use of the Service. For matters not specified in these Terms, relevant South Korean laws such as the Basic Telecommunications Act, Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., Information Communication Ethics Committee Guidelines, Program Protection Act, and other related laws and customs will apply.
Article 3 (Definitions)
- 1. Terms used in these Terms and Conditions are defined as follows:
1) User: A member or non-member who accesses the Service provided by Gwangju Tourism.
2) Member: An individual who agrees to these Terms and Conditions, obtains an ID (unique number) and PASSWORD (password), and undergoes real-name verification.
3) Non-member: An individual who uses the Service provided by Gwangju Tourism without signing up as a member.
4) ID (Unique Number): A combination of letters and numbers selected by the user and approved by Gwangju Tourism for identifying the member and facilitating their use of the Service (one ID is issued per resident registration number).
5) PASSWORD (Password): A combination of letters and numbers set by the user to protect their information.
6) Termination of Use: An expression of intent by Gwangju Tourism or a member to end the use of the Service after having used it.
- 2. Definitions of terms not specified in paragraph 1 will follow the relevant laws and the guidelines for each Service.
Chapter 2: Service Use Agreement
Article 4 (Formation of Agreement)
- The Service Agreement is formed through the user’s agreement to these Terms and Conditions and Gwangju Tourism’s acceptance of the user’s application to use the Service.
Article 5 (Application for Use)
- Application for use is made by entering personal information on the membership information screen of the Service in accordance with the application form required by Gwangju Tourism.
Article 6 (Acceptance of Application)
- 1.Gwangju Tourism will accept the application for the Service if the user accurately provides the required information as stipulated in Article 5, except in special circumstances.
- 2.Gwangju Tourism may withhold or limit the acceptance of an application until the reasons for restriction are resolved in cases including, but not limited to:
1)The provided information is found to be false (e.g., using pseudonyms, fake names, or misappropriated resident registration numbers) or there are reasonable grounds to suspect it is false.
2)Other situations deemed necessary by Gwangju Tourism.
- 3.Gwangju Tourism may reject an application in the following cases:
1)The application is not made under the applicant's real name.
2)The application uses another person's name.
3)The application contains false information.
4)The application is intended to disrupt public order or morals.
5)The application does not meet the requirements set by Gwangju Tourism.
Article 7 (Change of Contract Information)
Chapter 3: Provision and Use of Services
Article 8 (Service Use)
- 1.Gwangju Tourism will commence providing the Service once the application is accepted, except for certain services which may begin on a designated date.
- 2.If the Service cannot be started due to business or technical reasons of Gwangju Tourism, it will be announced on the site or notified to members.
- 3.The Service is available 24 hours a day, year-round. However, it may be temporarily suspended due to business or technical reasons, and Gwangju Tourism may schedule temporary suspensions for maintenance or operational purposes. Such instances will be announced beforehand or after the fact.
- 4.Even after becoming a member, some services may only be available to certain members based on the service provider's requirements.
- 5.Gwangju Tourism may divide the Service into different sections and set separate availability times for each section, which will be announced in advance.
Article 9 (Modification, Suspension of Service, and Storage and Use of Information)
- 1.Users agree that Gwangju Tourism is not responsible for any loss of messages or data due to national emergencies, power outages, service equipment failures outside Gwangju Tourism’s control, or other force majeure events.
- 2.If Gwangju Tourism must temporarily suspend the Service due to operational difficulties, it will provide notice at least one week in advance. Gwangju Tourism is not responsible for users' failure to see the notice during this period. The notice period may be shortened or waived for valid reasons. Gwangju Tourism is not responsible for loss or deletion of messages or data during such suspensions.
- 3.If Gwangju Tourism must permanently discontinue the Service, the notice period is one month.
- 4.Gwangju Tourism may temporarily modify, change, or suspend the Service with prior notice and will not be liable to members or third parties.
- 5.Gwangju Tourism may suspend the Service if a user violates these Terms, and may restrict access or delete all or part of the user's posted content.
- 6.For long-term inactive members, Gwangju Tourism may suspend the Service after a one-week notice period following an announcement.
Article 10 (Provision of Information and Advertisement)
- 1.Gwangju Tourism may provide users with various information and advertisements via email, postal mail, SMS, DM, or messenger. Users may opt out of receiving such information if they do not wish to receive it
- 2.Gwangju Tourism may display advertisements on the Service screens, website, or emails, and users are deemed to agree to such advertising.
- 3.Gwangju Tourism is not responsible for any losses or damages resulting from users’ participation in promotional activities or communications with advertisers
Article 11 (Deletion of Posts or Content)
- 1.Gwangju Tourism may provide users with various information and advertisements via email, postal mail, SMS, DM, or messenger. Users may opt out of receiving such information if they do not wish to receive it 1)Defame or damage the reputation of Gwangju Tourism, other members, or third parties. 2)Violate public order or morals. 3)Involve criminal activities. 4)Infringe upon the rights of third parties, such as copyrights. 5)Be inconsistent with the nature of the Service. 6)Violate any applicable laws or regulations set by Gwangju Tourism.
- 2.Gwangju Tourism reserves the right to edit, move, or delete content posted on the Service after three days' notice if the content violates these Terms or is deemed inappropriate. Content posted by terminated members may also be deleted without notice.
- 3.Gwangju Tourism may delete posts that have lost their relevance or purpose after a one-week notice period following an announcement.
Article 12 (Copyright of Posts)
- 1.Copyright of posts made by members on the Service belongs to the members, and Gwangju Tourism may use these posts on other services.
- 2.Members are fully responsible for any legal liabilities arising from copyright or program copyright infringements related to their posts.
- 3.Members may not use information obtained through the Service for commercial purposes.
Article 13 (Ownership of Gwangju Tourism)
- 1.Intellectual property rights and other rights related to the Service, software, images, marks, logos, designs, service names, information, and trademarks provided by Gwangju Tourism are owned by Gwangju Tourism.
- 2.Except where explicitly authorized by Gwangju Tourism, members may not modify, lease, loan, sell, distribute, create derivative works, assign, re-license, or commercially exploit any of these properties, nor allow third parties to do so.
Chapter 4: Obligations of Parties
Article 14 (Member’s Obligations and Information Security)
- Members must provide complete and accurate information (hereinafter referred to as "Registration Information") when registering for the Service. Additionally, members must promptly update their Registration Information if any changes occur.
- After completing the registration process, members will receive an ID and Password. To manage their ID and Password, members must:
- -Report immediately to Gwangju Metropolitan City Tourism Corporation (hereinafter referred to as "Gwangju Tourism") if there is any unauthorized use of their Password or ID.
- -Ensure they log out securely after each session.
- Members agree not to engage in the following activities while using the Service:
- -Acts that harm others (including a minority) such as: a. Unauthorized use of another person's ID, PASSWORD, or resident registration number, or impersonating others. b. Falsely representing relationships with others. c. Defaming others by disseminating true or false information with the intent to damage their reputation. d. Spreading false information to gain financial benefits or to harm others. e. Continuously sending messages, sounds, texts, images, or videos that cause shame, disgust, or fear, disrupting the recipient’s daily life. f. Commercial activities using the Service without prior approval from Gwangju Tourism. g. Using another person's telecommunications service name
- -Posting or sending unsolicited or unauthorized advertisements, promotional materials, junk mail, spam, chain letters, or pyramid schemes.
- -Posting, publishing, or sending obscene or pornographic content, including text, software, music, photos, graphics, video messages, etc.
- -Posting, publishing, or sending content for which the member does not have the rights, including intellectual property rights
- -Posting, publishing, or sending software viruses or any other code, files, or programs that could damage, interrupt, or limit computer software, hardware, or telecommunications equipment
- -Posting, publishing, or sending materials that include other computer codes, files, or programs, or collecting or storing other users' personal information.
- -Engaging in gambling or lottery activities.
- -Distributing information related to solicitation of prostitution or facilitating immoral activities.
- -Engaging in other illegal or inappropriate actions.
- Members must comply with these Terms and Conditions and relevant laws
Article 15 (Gwangju Tourism’s Obligations)
- Gwangju Tourism will, barring special circumstances, ensure that the Service is available to members from the date the service is scheduled to begin.
- Gwangju Tourism is obligated to provide the Service continuously and stably as outlined in these Terms and Conditions.
- Gwangju Tourism will be liable for any damage caused to members only if the damage results from Gwangju Tourism’s intentional or grossly negligent actions, and the liability will be limited to ordinary damages.
- Gwangju Tourism will promptly handle opinions or complaints raised by members if deemed valid. If prompt resolution is not possible, Gwangju Tourism will notify the member of the reasons and the processing schedule.
- Gwangju Tourism will endeavor to protect members' personal information, including registration details, as required by relevant laws and as described in Article 16.
Article 16 (Privacy Policy)
- Gwangju Tourism collects information about members through the information provided at registration and uses this personal information for the purpose of fulfilling the service contract and providing services as stipulated in the contract.
- Gwangju Tourism will not disclose or distribute members' personal information obtained through the service to third parties without the member's consent or use it for commercial purposes, except in the following cases:
- -When required by law enforcement agencies for investigative purposes.
- -When requested by the Information Communication Ethics Committee.
- -When required by other legal procedures.
Chapter 5: Termination of Contract
Article 17 (Termination of Contract and Restriction of Use)
- If a member wishes to terminate the service contract, they must apply for termination directly through the website.
- Gwangju Tourism may require or change a member's ID and PASSWORD for reasons related to security, ID policies, or smooth service provision.
- Gwangju Tourism may terminate the service contract without prior notice if the member engages in any of the following:
- -Registration with false data, such as using pseudonyms or stolen resident registration numbers.
- -Involvement in criminal activities.
- -Using the Service to undermine national interests or public welfare.
- -Unauthorized use of another’s service ID and password.
- -Damaging or harming others’ reputation or causing disadvantages.
- -Registering under multiple IDs by the same user.
- -Disrupting the Service or hindering its proper use.
- -Violating any related laws or Gwangju Tourism's usage conditions.
Chapter 6: Miscellaneous
Article 18 (Fees and Paid Information)
- The use of the Service is generally free. However, this does not apply to separate paid information and services as specified by the Service
Article 19 (Prohibition of Assignment)
- Members may not transfer, gift, or use as collateral their rights to use the Service or any other contractual position to others
Chapter 7: Liability and Indemnification
Article 20 (Indemnification)
- Gwangju Tourism will not be liable for any damages incurred by members in relation to the free services provided unless such damages result from Gwangju Tourism's significant negligence.
Article 21 (Disclaimer)
- GGwangju Tourism is exempt from responsibility for failing to provide services due to natural disasters or other force majeure events.
- Gwangju Tourism is not responsible for service disruptions caused by the member’s fault.
- Gwangju Tourism is not liable for any damages related to the benefits or materials obtained from the Service.
- Gwangju Tourism is not responsible for the reliability, accuracy, or content of information posted by members.
Article 22 (Jurisdiction)
- In the event of a dispute related to the use of the Service, Gwangju Tourism and the member must make all necessary efforts to resolve the dispute amicably.
- Notwithstanding the above, if a lawsuit is filed regarding a dispute arising from the use of the Service, the court having jurisdiction over the location of Gwangju Tourism will be the competent court.
Addendum
- (Effective Date) These Terms and Conditions will be effective from July 1, 2009.
Participation Terms
Article 1: Definitions
- 1."Exhibitor" refers to a company, association, organization, or individual that submits an application form to participate in the exhibition.
- 2."Exhibition" refers to the Gwangju Food Fair 2024.
- 3."Organizer" refers to the Kimdaejung Convention Center, located at 30 Sangmunuri-ro, Seo-gu, Gwangju Metropolitan City.
Article 2: Application for Participation
- 1.The Exhibitor must pay the application fee (booth fee, technical support fee) upon submitting the application form, and the agreement is considered effective upon payment. However, if the exhibition area is fully booked or if the planned items are deemed unsuitable for the exhibition, the Organizer may refuse to accept the application. Additionally, after the application is accepted, the Organizer may refund the application fee within 15 days based on the exhibition circumstances.
- 2.Any entity wishing to participate in the exhibition must complete and submit the designated application form to the Organizer.
- 3.The Exhibitor must immediately notify the Organizer of any changes to the submitted application form or other documents. The Exhibitor is responsible for any disadvantages arising from failure to notify.
Article 3: Booth Allocation
- 1.The Organizer will allocate exhibition locations based on application order, nationality, nature of exhibited items, application area, and the location of the applicant, respecting the Exhibitor’s preferences as much as possible. The Exhibitor may not raise objections.
- 2.If there are special circumstances, the Organizer may change the assigned booth location and area in consultation with the Exhibitor before the exhibition setup period. The Exhibitor must cooperate with the Organizer’s requests as much as possible, except in cases of force majeure.
Article 4: Exhibition Management
- 1.The Exhibitor must display the items specified in the application form and assign staff to manage their booth diligently.
- 2.If the Exhibitor displays items different from those specified in the application form or items not suitable for the exhibition, or engages in unauthorized direct sales, the Organizer may immediately order suspension, removal, or expulsion. In this case, the participation fee will not be refunded, and the Exhibitor cannot claim compensation.
- 3.The Organizer may restrict access to the exhibition hall for specific individuals if necessary.
- 4.The Exhibitor may not transfer, resell, or exchange all or part of the assigned exhibition space to others without the Organizer’s written consent.
- 5.The Exhibitor may not alter the exhibition hall’s floor, ceiling, pillars, or walls with paint, adhesives, etc., and must provide appropriate compensation for any damage to the exhibition hall as requested by the Organizer.
- 6.The Organizer may selectively exclude or restrict exhibited items or exhibition activities to maintain order, safety, and prevent socially problematic actions.
Article 5: Payment Conditions
- 1.The Exhibitor must pay 50% of the total participation fee and technical support fee as a deposit within one week of submitting the application form and must pay the remaining 50% by the application deadline of September 13, 2024. If the application form is submitted after the deadline, full payment is required.
- 2.If the Exhibitor fails to pay the participation fee, technical support fee, or other related costs, the Organizer may withhold participation until full payment is made or selectively withhold the Exhibitor’s exhibited items.
Article 6: Cancellation or Change by the Exhibitor
- 1.If the Exhibitor cancels all or part of the reserved exhibition space, they must notify the Organizer in writing immediately.
- 2.If the cancellation notice is received by September 13, 2024, the Organizer will refund 50% of the participation fee related to the canceled space. Otherwise, if the notice is received after September 13, 2024, no refund will be given.
- 3.No interest will be paid on the refunded amount.
Article 7: Cancellation or Change of the Exhibition
- If the Organizer cancels the exhibition, the full participation fee already paid will be refunded to the Exhibitor. However, if the exhibition is canceled or the date is changed or reduced due to force majeure or other circumstances not attributable to the Organizer, no refund will be given. In such cases, the Exhibitor cannot claim compensation from the Organizer.
Article 8: Setup and Display of Exhibits
- 1.The Exhibitor must complete the setup, import, and display of exhibits within the designated period.
- 2.The height of exhibits must not exceed 4 meters, and the weight limit for exhibits is 5 tons per square meter (1m x 1m).
Article 9: Removal of Exhibits and Equipment
- The Exhibitor must remove all exhibits and equipment within the designated period. If removal is delayed, the Exhibitor must immediately pay the Organizer for any related costs incurred.
Article 10: Exhibition Costs, Risk, and Insurance
- 1.The Organizer will take appropriate security measures for Exhibitors and visitors.
- 2.The Exhibitor is fully responsible for any damage or theft of exhibits and equipment within the allocated area during the exhibition, setup, and dismantling periods.
- 3.If the Exhibitor causes fire, theft, damage, or other accidents intentionally or due to negligence, they are fully liable for compensation and must also obtain insurance for their exhibits.
Article 11: Fire Prevention Rules
- 1.All materials used in the setup and within the exhibition hall must be appropriately fire-resistant according to fire regulations.
- 2.The Organizer may request the Exhibitor to make fire prevention adjustments if necessary.
Article 12: Supplementary Regulations
- 1.The Organizer may establish supplementary regulations not specified in the participation agreement as needed.
- 2.Supplementary regulations will become part of the participation agreement, and the Exhibitor must comply with them.
- 3.The Exhibitor must comply with the regulations of the Organizer and the Gwangju Tourism Organization.
Article 13: Dispute Resolution
- Disputes arising between the Organizer and the Exhibitor regarding the interpretation of this participation agreement will be resolved by the Arbitration Board of the Korean Commercial Arbitration Board, and such decisions cannot be contested in court.
